1. Acceptance of Terms
Welcome to OptionsPlay. These Terms and Conditions (“Terms”) govern your access to and use of OptionsPlay’s online trading analytics software and services (collectively, “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
OptionsPlay provides a subscription-based service offering access to proprietary trading analytics software designed to assist users in making informed trading decisions. The Service includes, but is not limited to, market data analysis, trade strategy tools, and educational resources. The Service is available to users who have registered for an account and subscribed to one of our subscription plans.
3. Subscription Terms and Renewal
Subscription: OptionsPlay offers various subscription plans. Details of these plans, including features and pricing, are available on our website.
Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled by the user. We will notify you in advance of any changes to your subscription terms or fees.
Cancellation: You can cancel your subscription at any time via your account profile. Cancellation will take effect at the end of the current billing cycle.
4. Promotional Offers
OptionsPlay may, from time to time, offer special promotional offers, plans, or memberships (“Offers”) designed to provide our users with enhanced opportunities to benefit from our services. The availability and specifics of these Offers are at the sole discretion of OptionsPlay, and we reserve the right to modify, revoke, or impose conditions on the acceptance and use of any Offer at any time.
Offer Eligibility
Determination of Eligibility: The eligibility for any Offer is determined by OptionsPlay at its sole discretion. We may consider various factors, including, but not limited to, the user’s subscription history, promotional offer history, and user account status.
Eligibility Restrictions: Members of households with an existing or recent OptionsPlay subscription may not be eligible for certain introductory Offers. We aim to ensure that Offers are distributed fairly and to the benefit of as wide a user base as possible.
Information Use for Eligibility: OptionsPlay may use information such as device ID, method of payment, or an account email address associated with an existing or recent OptionsPlay subscription to assess Offer eligibility. This helps us prevent fraudulent use of Offers and ensure that promotions are offered to the intended audience.
Conditions and Limitations
Disclosure of Conditions: The specific eligibility requirements, limitations, and other conditions related to the Offer will be disclosed at the time of sign-up for the Offer or through other communications made available to eligible users. Right to Revoke Offers: OptionsPlay reserves the right to revoke an Offer and place the user’s account on hold if we determine, at our sole discretion, that the user is not eligible or has violated any terms of the Offer. This is necessary to ensure fairness and the proper use of promotional Offers across our user base.
Promotional Periods and Offer Adjustments: The duration and specific benefits of any Offer will be outlined in the promotional materials. OptionsPlay reserves the right to adjust or end promotional periods at any time, subject to applicable laws and regulations.
5. Payments and Billing
5.1. Billing Cycle
The subscription fee for OptionsPlay’s service, along with any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the “Account Profile” page. The length of your billing cycle will depend on the type of subscription plan you choose when you sign up for the service. In some cases, your payment date may change, for example, if your Payment Method has not successfully settled, when you change your subscription plan, or if your paid subscription began on a day not contained in each month. Visit the OptionsPlay website and click on the “Subscriptions” link on the “Account Profile” page to see your next payment date. We may authorize your Payment Method in anticipation of subscription or service-related charges through various methods, including authorizing it up to approximately one year of service as soon as you register.
5.2. Payment Methods
To use the OptionsPlay service, you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees related to the processing of your Payment Method.
5.3. Updating Your Payment Methods
You can update your Payment Methods by going to the “Subscription” page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
5.4. Cancellation
You can cancel your OptionsPlay membership at any time, and you will continue to have access to the OptionsPlay service through the end of your billing period. To the extent permitted by applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial membership periods or unused OptionsPlay content. To cancel, go to the “Subscription” page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click “Subscription” on the “Account Profile” page.
5.5. Changes to the Price and Subscription Plans
We may change our subscription plans and the price of our service from time to time. We will notify you at least one week before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.
6. User Accounts and Responsibilities
You must provide accurate, complete, and updated registration information. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. OptionsPlay is not liable for any loss or damage arising from your failure to comply with this provision.
7. Intellectual Property Rights
All intellectual property rights in the Service, including software, databases, trademarks, and content provided by OptionsPlay, are owned by or licensed to OptionsPlay. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes. The OptionsPlay service and any content accessed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household, unless otherwise allowed by your subscription plan. Except for the foregoing, no right, title, or interest shall be transferred to you.
8. Compliance with Laws and Restrictions on Use
You agree to use the OptionsPlay service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules, and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized by us, you agree not to:
(i) Archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the OptionsPlay service;
(ii) Circumvent, remove, alter, deactivate, degrade, block, obscure, or thwart any of the content protections or other elements of the OptionsPlay service, including the graphical user interface, any advertising or advertising features, copyright notices, and trademarks;
(iii) Use any robot, spider, scraper, or other automated means to access the OptionsPlay service;
(iv) Decompile, reverse engineer, or disassemble any software or other products or processes accessible through the OptionsPlay service;
(v) Insert any code or product or manipulate the content of the OptionsPlay service in any way;
(vi) Use any data mining, data gathering, or extraction method;
(vii) Upload, post, e-mail, or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment associated with the OptionsPlay service, including any software viruses or any other computer code, files, or programs.
We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
9. Limitation of Liability and Disclaimer of Warranties
The Service is provided “as is” and “as available” without any warranties, express or implied. OptionsPlay does not warrant that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, OptionsPlay disclaims all warranties, including, but not limited to, warranties of merchantability and fitness for a particular purpose. OptionsPlay will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use the Service.
10. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without giving effect to any principles of conflicts of law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.
11. Changes to Terms and Conditions
